These Terms of Service ("Terms") govern your access to and use of our website and the purchase of any products through it (collectively, the "Services"). By accessing our Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order with us. By using the Services, you represent that you meet this requirement. 2. Products, Descriptions & Pricing

We make reasonable efforts to display our products, descriptions, and pricing accurately. However, we do not warrant that product descriptions, images, pricing, or other content on the Website are error-free. If a product is listed at an incorrect price or with incorrect information due to a typographical, technical, or pricing error, we reserve the right to refuse or cancel any order placed for that product, whether or not the order has been confirmed and payment collected — in which case we will issue a full refund.

We reserve the right to limit the quantity of items purchased per person, per household, or per order, and to discontinue or modify any product at any time.

Prices are shown in the currency applicable to your storefront region and are exclusive of applicable taxes and duties unless stated otherwise at checkout.

3. Medical Disclaimer — Please Read Before Purchasing or Using Our Products

Thermatec devices are designed to support recovery as part of a healthy training and wellness routine. They are not intended to diagnose, treat, cure, or prevent any disease, and are not a substitute for professional medical advice, diagnosis, or treatment.

Consult a physician before use if you are pregnant, nursing, living with a diagnosed medical condition, or taking photosensitizing medication.
For sensitive skin, start with shorter sessions to test skin tolerance.
Do not use if you have damaged or inflamed skin, or a known photosensitivity condition, without first consulting a doctor.
Individual results vary. Statements about our products have not been evaluated by the FDA or any equivalent regulatory body in the UK, Australia, or Canada.

By purchasing and using our products, you acknowledge and accept the above, and you agree to use the product only as directed in the included instructions.

4. Orders & Payment

By placing an order, you are making an offer to purchase the product(s) in your cart, which we may accept or decline at our discretion (for example, in cases of suspected fraud, pricing errors, or product unavailability). Order confirmation does not guarantee acceptance.

You agree to provide accurate, current, and complete payment and billing information. We use third-party payment processors to handle transactions; your payment information is subject to those processors' own terms and security practices.

5. Shipping & International Orders

We ship to the United States, United Kingdom, Australia, and Canada. Estimated delivery times shown at checkout are estimates only and not guaranteed. Title and risk of loss for products pass to you upon our delivery to the shipping carrier.

For orders shipped outside the United States, you are responsible for any customs duties, import taxes, or other fees levied by the destination country. These are not included in the product price or shipping cost shown at checkout unless explicitly stated.

6. Returns, Refunds & Warranty

We offer a 30-day money-back guarantee from the date of delivery on eligible products, subject to the product being returned in accordance with our Return Policy. Please refer to our Return Policy page for the full process, condition requirements, and any exclusions.

Products purchased from Thermatec include a 12-month manufacturer's warranty from the date of purchase, covering defects in materials and workmanship under normal use. Warranty coverage does not extend to damage caused by misuse, unauthorized modification, or normal wear and tear. An extended warranty may be available for purchase separately — see the product page or contact us for current extended warranty options and pricing.

7. Intellectual Property

All content on the Website — including text, graphics, logos, images, product photography, and software — is the property of Thermatec or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Website without our prior written consent, except as necessary to use the Services for their intended personal, non-commercial purpose.

When using the Services, you agree not to:

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including in relation to UK, Australian, or Canadian consumer protection legislation where applicable to you.

You agree to indemnify and hold Thermatec harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Services, your violation of these Terms, or your violation of any rights of a third party.

12. Dispute Resolution

For US customers: Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved informally by contacting us at the email below. If a dispute cannot be resolved informally, you and Thermatec agree that it will be resolved through binding individual arbitration, and you waive the right to participate in a class action or jury trial, except where prohibited by applicable law.

For UK, Australian, and Canadian customers: The arbitration provision above does not limit any statutory rights you have as a consumer under the laws of your country, including your right to bring a claim in the courts of your jurisdiction where mandatory consumer protection law entitles you to do so.

13. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles, except to the extent that mandatory consumer protection laws of your country of residence (UK, Australia, or Canada) apply and cannot be excluded by agreement.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

15. Severability
